Client Memory Vault Terms & Custodian Agreement

1. Direct Preservation Custodian Relationship

When you activate a Client Memory Vault on Pholume, you enter into a direct consumer custodian agreement with Pholume. Pholume acts as an independent digital preservation custodian, completely decoupled from the originating photography studio.

2. The Never-Delete Guarantee (Axiom 4)

If the originating photography studio closes its business, downgrades its account, or ceases operating on Pholume, your vaulted gallery and lossless media are NEVER deleted, compressed, or removed.

3. Statutory Nominee Protocol (DPDP Section 14 & Rule 14)

You hold the statutory right to designate a nominated legal representative (spouse, child, sibling, or designated heir) to inherit retrieval access to your permanent memory vault in the event of death or incapacity.

4. Zero Biometric Scanning & Privacy-First Architecture (Axiom 3)

Pholume strictly prohibits facial recognition scanning, facial geometry indexing, and biometric profiling. Visual memories are never utilised for AI training models or machine learning algorithms.

5. Lossless Original Quality & Zero Egress Download Rights

Couples and authorised guests enjoy unlimited, unrestricted downloads of full-resolution original media and batch ZIP archives with zero download surcharges and zero bandwidth throttling.

6. Tenure, Pricing & 48-Hour Pre-Erasure Notice (Rule 8(2))

Memory Vault tenures are provisioned at ₹499/year or ₹1,499 for 5 years (inclusive of 18% GST). Prior to any permanent media purge post-grace period, Pholume transmits a statutory 48-hour pre-erasure warning notice under Rule 8(2) of the DPDP Rules 2025.

7. Voluntary Right to Erasure & Consumer Refunds

Clients may exercise voluntary erasure under Section 12 of the DPDP Act 2023 at any time. Cancellations requested within 7 days of initial activation without initiating bulk ZIP downloads qualify for a 100% full refund under Consumer Protection Rules 2020.

8. Governing Law & Grievance Redressal

Governed by the substantive laws of the Republic of India. Inquiries may be addressed to our dedicated Grievance Desk at grievance@pholume.com, with statutory escalation available to the Data Protection Board of India (DPBI) via dpbi.gov.in.
